Department of Motor Vehicles (DMV) Hearings

Negligent Operator Hearings

The DMV monitors the driving record of licensed drivers in California. It is based on a point system and when you get moving violations on your driving record DMV keeps track. If you get four points within a one year period of time it will trigger a license suspension.
The DMV will start sending warning letters as you begin to acquire points. With two points you get a warning letter. With a third point on your record it advises that if you get another it will result in a suspension. On the fourth point, the letter states your license is being suspended.
When you get the suspension letter you can request a hearing with the DMV Driver's Safety office to try to convince the DMV not to suspend your license. This is where having an attorney can help you. Medical Evaluation Hearings
Vehicle code section 12806 allows the DMV to refuse or suspend the driver's license of anyone the DMV believes cannot safely operate a vehicle due to physical or mental conditions.
Often these hearings are triggered by a doctor reporting a medical condition to the DMV.
The referral for medical review may be based on several different conditions such as a lapse of consciousness, physical inability to drive, mental health or ability.
The DMV has the ability to require a written test, a driving test, and hearings at the Driver's Safety office with a hearing office to determine whether a person's driving privilege will be taken.

Lack of Skill Hearings
The DMV can take action against a person's driving privilege if the DMV determines the person lacks the skill to safely operate a motor vehicle.
This type of issue usually stems from a police officer referring a person to the DMV. It could be based on a traffic ticket or something the officer observes.
